why did you give a 11 year old kid a smartphone with internet connection and a 02 contract.
    sorry but, themselves to blame.
regulatory breach of the duty of parents

I cant understand why so many little kids, 10years, have iphones and samrtphones, really, my first telefon with 10 years was thet:
    http://www.mytoys.de/Fisher-Price-Fi....03.23/1541058

and with 12 years my first telefon had a prepaid card with 5€ for really important calls and to be avaiable for my parants.
Also i wouldnt buy my 10 year old kid a smartphone with a contract, sorry this is really silly.

    Hey.

    Sorry to hear your problem.

As listed right above, the rule clearly says to give money back.

regarding the laws in our country :
An 11 yo is not 'geschäftsfähig'. (He does not have the legal capacity to do any kind of bunsiess withour parental aproval, inlcuding buying things for an amount of money larger than the average pocket money of somebody that age).
If somebody takes that much money from a person of that age without the parents approval, the person or party has to give back all the money if requested by the parents. It simply is not legal for anybody to sell things for such a high price to an 11yo without having the parents approval.

    check wikipedia :

If the party that sold things to your underage son is not reacting quickly, just get a lawyer and get all your money back for sure

Good to know - but without Supercell making contact with me then I'm kind of buggered! - Lawyer comes at a cost too. I've contacted Unitymedia since they contacted me first to say his Sim Card had been deactivated due to excess usage...

As you have well said. You're a "guardian". And your task is it to monitor your son and what he's doing. As a 11 year old it's easy to make fkups, he's not to blame, even though as a 11 year old you should be able to read and know what money (€/$) is.

Whatever, especially with your son apparently having infinite access to a credit card or the o2 account, I don't think you'll get your money refunded. A 11 year old shouldn't have access to that. Especially not if you can't or are not willing to monitor his actions.

Maybe the company is going to show some good will, that's the only thing you can hope for.

Edit: As harsh as it sounds, but I'm not even sorry for your loss, in case you shouldn't get it back. Even if it sounds heartless, but that's just so wrong.

I don't need to go in to depth about being a responsible parent - a mistake has been made and I take responsibility hence why I'm trying to sort it out..

He had no credit card since there isnt one attached to his Google Wallet.

Yes I'm to blame - I'm not debating that.. As to why my son has a smart phone I don't need to be educated on that subject, times have changed. For your knowlege he has no 02 contract - he has a family account with Unitymedia, hope that helps...

Never used Google/Android but this sounds strange.

Much better with Apple. You need a separate credit card for purchases inside a game (nothing to do with your carrier) and the parents have plenty of controls for in-app purchases in the settings.

You've contacted Supercell in the best way (in-game) and will need to wait.

I'm afraid you best be prepared for bad news as it's always very difficult to prove these matters.

Selber schuld.
    Ehrlich gesagt, selber Schuld.
Ich hasse die menschen die ihren Kindern schon mit 8-12 Jahren ein smartphone oder iphone schenken, die sollen ihr leben draussen verbringen und nicht vor einem Bildschirm, schrecklich.

Then over what service was he able to buy the gems if it wasn't credit card?
Afaik you can do it via the provider, but it requires extra access. I for example got base (e+) contract, and I can't just purchase via them without any further setting.
Or google gift cards, which I doubt, since these you gotta pay in the store and it doesn't sound like cash money is used.

You know, usually you sign contracts and read the terms of service (AGB german), and I think it says when you sign something, that you're responsible for what happens.
