Are you serious? Nintendo would only be able to trademark Golem's sprite image. It is not even possible to trademark a mythical creature, unless you invent it. Nintendo did not invent the golem, it has been around for hundreds of years. It is technically defined as a creature of clay brought to life by magic, meaning CoC actually represents it more accurately.

Golems are a Jewish mythology and I don't think they were invented 1996, the time pokemon released their game with golem in it.

Also, the first 'well-known anyway' game with a golem in it is Dungeons and Dragons which was released in 1970. Then people liked the idea and made golems.

By the way, the earliest written source that can be found about creation of golems were created in 1165-1230. I think some of them were able to create golems or something. Magic.
