if you are recruiting from Global and your problem rate is only 90% thats actually pretty good.

Asking SC to completely change the game to suit you is not doing something about it. That's just lazy.

There are literally hundreds of thousands of clans that don't have this problem. That should tell you that it's an internal clan problem and not one with the game.

You have created this problem in the clan yourself and your lack of understanding that and you're lack of action (despite the countless post with good advice from clans that don't have your problem) prove that you are a poor leader.

If you want to talk numbers we first need to know how many clans in COC overall but they dont give that out.

You do not have the right to illegally access other people's accounts. That is not a human right and your conflating of the two shows that you understand neither human rights nor the law.

As it is a criminal offence (S1, Computer Misuse Act, 1990 in the UK, CFAA for you as I suspect that you are from the US), suing would not be necessary as restitution would be part of the sentence. Prosecutions, far from being laughed out of court, have been successfully made under these instruments. That said, SC would never implement something that was illegal so the point is moot.

We're not accessing their account. We are accessing their base. There is a difference. In order for Clash of Clans to use their base on the internet, they have to be granted rights to it. Just like if it was illegal to access their base, their base should not be allowed to show up in my game.

Second of all, the elixer collectors generate elixer for free. If theft was an issue then anyone battling in Clash of Clans would be guilty of a crime for stealing elixer. And since I can buy elixer and have it stolen because someone battles me, you can take them to court already if you wish. But since filing fees are greater than what some pay in a month, most player wouldn't file a court challenge and then they would be seen as arguing over a game when they wouldn't win because there is a law that "it is their mutual responsibility" which in this case is to play by the rules of the clan.
