I understand as a developer myself as it might be challenging to find a perfectly clean way to implement this feature but it's a very important and needed one.
Couple clean possibilities:
- Make the heroes ALWAYS available regardless, even out of war.
- Dramatically decrease the time it takes to upgrade the heroes and increase their cost in terms of dark elixir (to balance the fact that many players sacrificed time and gems to level up their heroes).
Less clean possibility:
- Take a snapshot of the heroes when war day starts and add them to both attacks.
