It's as clear as day: you tell people to accept it and move on, so they won't get a refund.
You really should stop quoting the ToS since it does very little to protect the interest of players as well as fair gameplay (see 3rd party softwares and multiple accounts). As far as i'm concerned my toilet paper serves its function better than the ToS.
All the ToS does is protect the interest of SC in terms of legal issues and has minimal consideration when it comes to player enjoyment of the game.
A company should be much more than what its ToS (a legal document drafted as a legal requirement to safeguard the company's interest) is.

Apple =/= bank. That is pretty obvious. No matter how you look at it.
Bank = where the individual has an account that stores their money.
Apple = the online retailer, because any IAP will show up in a bank statement as charged by Apple. Chargeback would mean contacting the bank directly, and the bank would take the hit, not the online retailer.
Well yeah, technically it is. Just because there's no direct price of gem per heroes, doesn't mean that direct convergent from ingame resource to gem doesn't exists.
Look at it this way, heroes got nerfed, cost remains the same, training time remains the same, regen time remains the same >>> gem cost unchange >>>>>> gem value is decreased for that particular purpose while gem price remains unchanged.
Sure they paid for a temporary advantage, and that turns out to be not much of an advantage as it used to be (not as much, but way below), that's called false advertising.
@bold: there's a limit to everything. One cannot be immuned from criticism/accusation just because they put "game is subject to change" in their TOS. When a good game developer rebalance something, they rebalance all aspects of it, not just the base stats.
