I goofed. This was totally wrong and I apologize on behalf of myself and Supercell for any inconvenience this caused!
Apparently you cannot use your AQ/BK on attack while sleeping, and they are technically "sleeping" while they are upgrading. They will still be available on defense however.
Here was my mistake, for transparencies sake:
Yes, to 100% clarify:
If you are upgrading your AQ or BK and enter the war phase of a clan war, they will be available to you for both attack and defense at the level they are being upgraded FROM. If your AQ/BK are new but haven't completed being built (that sounds weird), they will be available at level 1.
