I am an attorney in Beaumont, Texas. I have begun putting together a class action complaint that I plan to file in the Eastern District of Texas in the near future. I will also be adding a page to my website where you can find more information about the lawsuit.
As was posted by someone last year, Supercell has perpetrated an on-going fraud on consumers all across the world. We are going to put a stop to that.
Below are a few things that will be included in the class action allegations:
i think there is a real case here.
Supercell has effectively made numerous unilateral changes and in sneaky unannounced ways to avoid attention.
- changing costs in units
- changing upgrading costs
- increasing build and upgrading times
- changing unit behavior (eg. archers have been dumbed down.. which increases cost to attain same effectiveness in long term from a trophy score perspective)
these negative changes are NEVER announced because they know these are UNILATERAL changes in the implied contract at the time when we purchase gems
when we purchase gems, we expect the gems to have the expected value at the time of which we purchase them... however, when the game mechanics are tweaked and changed, the value of the gems decrease... and also, the effectiveness to which the gems would have achieved are diminished for the same reasons (loot in game is turned down to a trickle, upgrade/building/training costs are constantly increasing)
all updates are focused on putting pressures to make players spend money. while nothing is done about the REAL issues in the game that would improve the game (horrible chat tab, no way to message anyone in this supposed "multiplayer" and "clan" game, tournament system is not a "clan" tournament, global chat is not truly global, replay retention is too short to be of real use, revenge history is too short, no attack history / replay, etc. etc.)
all their focus is on making changes to increase demand for elixir and gold, decreasing and slowing the amount of free elixir and gold available, and putting new colors on units and walls, and useless animations on buildings and units.
these game mechanic changes are essentially a break in the implied contracts with all of us, and Supercell makes them willy nilly with every server maintenance break. Supercell is acting with impunity and this is both unethical and illegal.
