What if it isnt a deal gone bad but exposing a thief to protect other traders? dont you want to know the person you are going to trade with is a known thief?

That is also a trade going bad so the same rule applies.

I know the sentiments behind it but we simply can't allow that. In some cases it might be a "thief" in lots of other cases it could be a misunderstanding or a trade going bad for other reasons. Trading is always done at own risk and things can go wrong whether it's intentional or not.

People can wrongly accuse others way to easy and it might end up in a fued. If you work out the trade through PM you need to work out the differences to PM.

it would be nice if we can "protect" our, what once was a nice community.. by trying to inform others.

and, unfortunately, pm does not work, since the scammer refuses to reply you.
