This has to be a joke right?

Hi all,

First off, I have been playing CoC's ever since it was released on iDevices, played it on iPhone 4s and my wifes iPad and loved it, what an amazing game, created a clan, spent money and got many many people playing it also so believe me, leaving the game is a kick in the nutsack for me :(

Why am I leaving the game? (not that many people will care) however, in my spare time, I create Chrome themes, normally people send me images and I make themes out of them (PS3 ones also)

Normal stuff like someone's wedding photo's, Halloween party pics etc etc and HD wallpaper's of things like Cars, Babes, Video Games etc etc.

I made a CoC one about 7 or so months ago to show my appreciation and love of the game, and it got just over 2000 users installed, probably about 40 or so of these users asked me about the game, I gave it double thumbs up and sent them to the App Store.

Today, the theme gets removed by Google because someone by the name of Ninja Heikkilä filed a DMCA claim on it?

Are you guys serious? So I used your image, I gave you guys publicity and never asked for a thing. All I did was enjoyed playing the game so much, it inspired me to share something back!

I do feel as if someone has kicked me in the nuts for no reason, especially when there are people on this forum using your image(s) for profile pics (avatars) and in signatures etc :(

Anyways, no hard feelings, just wanted to say THANK YOU for such a great game and maybe next time, contact the creator and ask them to remove it.

I googled her, seems she doesn't have any links to SC but is in Legal Services so perhaps cracks down on all copyright material there?

Lemme get this straight. You are quitting the game becuz they took down a wallpaper you made for copyright? Little extreme to me.

Hope it's not everyone they are doing it to facescraper, otherwise you had better change your signature :( lol

WarPig : was it a little extreme? probably but whoever this 'ninja' person is (and she does look cute ;) ) could have just sent me a message as my email was on the theme also. (in the description) or just asked Google to remove it but to file a DMCA law suit? now that's extreme lol

from what I understand of the Google email, "if" I counter it then it will be taken to court ♥♥♥♥!
guess I'll just let it go and say goodbye to the theme itself :)

SC said they are happy for people to use images from a Fan Kit they posted awhile back. There were 3 pages of terms and conditions but it was to the general effect that they were happy for you to use them on forums, fan sites etc. I'm guessing the person that removed your material did so on their own accord without SC's involvement.

that could be facescraper becuse when I created it, I posted it on the CoC Facebook fanpage and whoever was managing the page gave it a Like, no one then contacted me :?

I gotta admit this ninja person is being a little bit of a ♥♥♥♥ but continue playing the game mate. Dont let some1 ruin your Clash experience.

I will continue to play WarPig, I must admit, I jumped a bit harsh when I got the email from Google.

I am sure Supercell would not mind me using the image just as a fan to promote what I still think is a great game.

Someone in your clan attacked a lawyer and 100%'ed them. They just found a way to 3 star you back lol.

Hey Chief,

This sounds very frustrating and I can understand why you're upset! Supercell does and must keep up strict standards of defending our Intellectual Property, or potentially lose the right to do so.

That being said, there are times when creative work by our players is unfortunately caught up incorrectly in this process.

We'll investigate this particular instance and see if there is anything we can do. My apologies for the frustration this has caused.

I must admit, I was very annoyed when I got the email however, I've had a hot chocolate and taken a few deep breathes lol

Obviously I am not giving my chrome theme link o here as I didn't come for publicity, this however is the image I used (thinking it was a-ok)

The image was the old loading screen, with the Barbarians charging and the cannon through the wall.

I got the image of a wallpaper site.

A law department in a business will handle all of the copyright issues SC has which will be thousands per day.

They will not contact people directly as most of the time that doesn't work threatening action however does.

You are not special you broke SC copyright rules so you got action threatened to be taken against you, welcome to the real world.

killtom, No way at all have I referred to being 'special' or not breaking the copyright rules.

It was simply a theme for a game I love so much to show appreciation and respect for Supercell and CoC.
Also to drive more players to the game if possible (which it did)

I didn't slap the logo/characters on a T-Shirt or Mug and sell them for profit, I didn't even claim the work done was mine, just the simple fact I took an image and themed it on Chrome.

I can't remember the exact wording now however, on the description it said something like: 'If Supercell and/or the CoC designers take offence to this theme, please contact me for removal' and had my email address next to it.

@ 38 years old, married and with children, just like many many other people and probably even yourself, I have lived a life in the 'real world' for some time now.

Obviously someone, people/companies etc will see things different than others.

Supercell don't want people using CoC images outside of this forum to protect it's brand, that's cool with me :) I have no argument there and will uphold the decision made by Supercell.

however, I would (and have) see things different.

I once owned a company of my own when I was living in Australia a few years back now, I paid for a designer to create me a character for my logo, it was very good and fitted my company image very nice.

I had terms & cons on using this image (for other people) just like anyone else but mine was simple.
without typing out the whole thing, it basically said:
use the company character to promote my company.
don't alter/change the character in any way unless written permission is given.
don't use the character in a way that would harm or damage the company and / or its profits <-- this broke down in to a few sections, i.e. don't use the character in any image(s) that would interpret an adult nature/gesture. blah blah blah...

I believe Nike use to do this (not sure if they still do) but you can(or could) use the Nike tick logo for a PC wallpaper design, have it tattooed on your skin, print it off and stick it on your car window.. whatever but, you could not use it in a design that would damage the company and/or reputation/profits. i.e.
Michael Myers could not be butchering babysitters to death with a giant Nike tick or Adult companies could not print the tick with the slogan "just do it" on to the size of a giant ♥♥♥♥♥ and you could not print it and stick it on a mug to make profit.

All that being said, the email Google got from this Ninja lady has been forwarded to me and it appears all she wanted was to have the theme removed, nothing else... that's cool beans with me :)

First, its great that the OP knew about the forum and Supercell got it resolved!

As an FYI many law firms that handle issues like this will flag anything that is remotely questionable. So just because a claim is filed does not mean that anything improper has been done. Also there is incentive to flag more items instead of less because it looks better to remove more potential infringements and they want to keep their job/ contract.

tldr/ lawyers can file claims that are not justified

Modern marketing is customer-oriented, where the hierarchy is power is reversed, putting the customers at the top.

They personally looked into and resolved this issue in the matter of hours...
