It obviously (to me at least) has to be fixed size wars. Otherwise it would be pretty well impossible to rank all clans in one set of tiers and the league idea becomes somewhat meaningless.
And if you are going to have fixed sizes, then it makes sense to use the current most common war size. Which is what they have done.
If your clan is serious about trying to get promoted every season, yes you might need to do this, although even then it will be the 15 strongest available.
But if you are a little less serious, or if after several wars it is obvious you are not going to be in the promotion or relegation spots, you might well bring in some of your weaker members just to get them a bigger share of the medals.
It is only one week a month, and most have already got used to the idea of frequently taking a week out to upgrade heroes - which they could of course do during CWL week.
But here I agree, they could have allowed members not on the roster to have a separate "normal" clan war at the same time. Although given the way rewards will be distributed, most clans are likely to put everybody in the roster after the first CWL anyhow.
Only divisive if you let it be. Good clans (in the sense of well knit, well run, not necessarily strong) won't find it so.
But yes, there are a lot of clans where it could be divisive - probably a lot of the same clans that want to restrict Clan Games rewards.
